Background

Andrew Taake is a Texas man who was convicted in the District of Columbia of assaulting law enforcement during the January 6, 2021, Capitol breach. He was sentenced to over six years in prison and was later pardoned by President Trump. According to CREW, after the pardon he was rearrested on unrelated charges.

The Case

Taake assaulted Capitol Police officers with pepper spray and a metal whip during the Capitol breach. The FBI and federal prosecutors described his conduct as part of the violence that injured law enforcement and disrupted the certification of the presidential election, damaging public trust in the peaceful transfer of power. He was sentenced to more than six years in prison for his role in the insurrection.

After President Trump's January 2025 pardon, Taake was rearrested on previous charges of soliciting a minor. CREW and other reporting have cited his case as an example of pardoned insurrectionists who face other serious criminal charges, underscoring the absence of traditional monitoring or parole for pardoned individuals and the public safety risks involved.

The Pardon

On January 20, 2025, President Trump granted Taake a full pardon under a proclamation covering certain offenses relating to the events at or near the U.S. Capitol on January 6, 2021.
